PFA Confirm Suarez Clause Does NOT Require Liverpool To Sell For £40m

The Luis Suarez saga has taken another twist tonight with PFA chief executive Gordon Taylor confirming that the much talked about clause in the strikers contract does NOT state that Liverpool have to sell him for £40m.

The Uruguayan hitman did a sensational interview with the Guardian last night claiming that he had both a verbal and written agreement with Liverpool that he would be allowed to leave this summer if a club in the Champions League came in with an offer of £40m or more.

The 26-year-old also confirmed that he’d brought in the help of the Professional Footballers Association to try and help force a move to Arsenal and it seemed as though the player thought he had their backing, with Liverpool seemingly in breach of contract after rejecting our £40,000,001 bid.

However, Taylor has been quoted in the Mirror this evening as saying that while there is an agreement in the clause that states Liverpool should enter negotiations if a club offers a minimum of £40m, it does not state that the club are obliged to sell at that price and it is not a simple buy-out clause.

Taylor feels the interpretation of the clause is causing confusion but there is no guarantee Suarez would be successful if he took his case to the Premier League and even if he did, the procedure would drag past the close of the transfer window meaning any move this summer is dead. Here’s what he said:

“If you are going to have a supposed buy-out clause it should be that, but it is different as it says if there is no qualification for the Champions League [by Liverpool] and if there is a minimum offer of £40million then the parties will get around the table to discuss things but it does not say the club has to sell.

“It quite clearly states £40million is a minimum offer for discussions, but it becomes really difficult with such clauses.

“There is a ‘good faith’ clause in relation to serious discussions but I can’t say it is cast-iron buy-out clause.

“Luis is one of our members and we want to be supportive, however, he may well have thought such an offer would trigger a move.

“The interpretation is not that simple by any means and there is no guarantee of getting a (successful) result if it is referred to the Premier League.

“I just feel like in any other transfer it is better for both parties to get around the table to try to resolve it.

“You are hoping the club say ‘If you are determined to go this is the figure we are looking at but if you are prepared to stay another year and you still want to go we will accept this much’.

“At the moment it is certainly festering and I don’t think it is a good situation for the player or the clubs involved.

“It is not edifying and that is why I feel we had to do our best to get round the table and see if there are grounds for consideration for the move but it (the clause) is not specific and 100% certain.

“We are in touch with both parties to try to see if some resolution can be achieved that is satisfactory to both sides.”

This is obviously not good news for Arsenal and it makes it that much harder for us to sign Suarez. Liverpool will do everything in their power to stop him joining us and even if the player now hands in a transfer request, there is nothing to suggest that would be enough to persuade Liverpool to sell to Arsenal.

Brendan Rodgers will know fine-well that selling us Suarez would all but end their hopes of finishing in the top-four next season, so it’s difficult to see where we go from here. I’m still not convinced Suarez is desperate to join Arsenal in particular, judging by his interview last night it seems like he just wants to play in the Champions League, so if Liverpool find a foreign  buyer I suspect he’ll jump at the chance as long as they can offer him Champions League football.

I’m hearing Brendan Rodgers has responded to Suarez’s comments with an interview of his own that’s due to be published at 11pm on Wednesday night. Let’s see what the Liverpool boss has to say….

    If a contract clause is left to interpretation then the judgement always falls with the party who did not draft the document.

    Looks to me like Liverpool have used Luis limited English here, which should be looked at extremely dimly.

    If the rumours of making Luis train alone now are true then he’ll soon have a case of constructive dismissal through singling him out from team activity. Why do Liverpool want to fight this? that’s what i don’t understand.

      I can really imagine Luis scouring the contract and signing it himself! Come on man, his agent and lawyers would have read the contract. Constructive dismissal…. he has clearly behaved in a way that warrants keeping his unsettling ways away from the other first team members. Liverpool would have to do a hell of a lot more to even start considering Constructive Dismissal.

      I just wonder where you get Suarez from, oh is that Ajax?
      Also the paper does not say Suarez clause or read later clause bit RELEASE clause and all we need after that is the number. Why anyone need interpretation for that?

    To be honest I just can’t see liverpool selling to us. If they sell him they are finished, and they know it. Wenger needs to move on now. The only way I see it happening is if he tells liverpool that he won’t play for them next season at all.

    You seriously read things differently than most, because I see his (originally) interview as very positive in the way as he is coming our way. I am convinced that this “clause” is indeed a release clause as long as Arsenal wins their qualification to CL, I think that is what they are waiting for and B.Rodgers will eat his words, socks and whatever afterwards.

You write it in a way that helps you to confuse peoples and to creat unrest with arsenal fans! I think it is better for everyone here to go and read it on skysport than here cos here it is the wrong report!

    But let arsene wenger keep trying to bring this player to emirate. If liverpool refuse to sell him at this great worthy price now, i think they are going lose d value nex summr, and i knw a player willingly to leave but keep won’t give his 100% best effort to dat team stil want to keep him to another year. It wil b a great loose if they do not sell him now bcause, d posibility of bn top 4 is zero, bcos dis player won’t happily play well for liverpool if they keep til next summer. And they r going to lose dis worthy price next summer. Therefore, it is the right time for liverpool to let him go this summer. Thanks

    Not sure how this changes anything. Suarez position at Liverpool is now untenable, and there are no other bidders besides Arsenal. Currently, Liverpool have two choices, stick him in the reserves or sell him for 40 million. Which one do you think they will choose?

There’s no hidden truth, the interpretation of the contract is very very clear to all of those who wants to see the end of the saga, especially arsenal fans who ‘re believe to see our dwonfall. Luis suarez, pls bear with us and stay for just one more season. Long live lfc.

    Well thats an arbitrary clause. “Negotiations” could mean anything but in good will, with a player clearly wanting to leave, it would mean that they would sell if an offer in the excess of £40m arrived. In addition, the clause should benifit the employee first. The club unspecified the clause and it is now up for interpretations. That’s clearly sloppy management and not Suarez’ fault. However, I still think Arsenal will get him. The pressure will be to high and theres no other suitable buyers willing to spend that much on him. If Arsenal increase it slightly they should get him. I mean, c’mon, who wants an unhappy Suarez? He’ll create havoc!

    Suarez’s agent Pere Guardiola’s a heavyweight who knows his clauses plus i find Suarez’s understanding of the spirit of the clause(handshakes & all ) very credible.
    A gotcha-clause undermines trust and loses you a key player – will Brendan deny they shook hands on the understanding Suarez could leave if they don’t make the CL???

    There’s something everybody’s negleting about SUAREZ.if this Suarez of a player have any crisis again about racist or anything else in the field of play(FOOTBALL).the polishment will be far worst than 10 match ban.So Arsene wenger is really doing Liverpool a BIG favour ,by try to make a hazardous signing of the century.Let’s cross our fingers and hope this gamble pays off without future crisis.

    This is very interesting language. To me it say Suarez can ask to be sold if Liverpool doesn’t qualify for CL and someone put a bid in for 40m. So Liverpool didn’t qualify, Suarez wants to go, and Arsenal bid 40m. So Liverpool will have to sell even if the wording say they don’t necessarily have to. It’s a matter of principle as the player will feel he was lied to. Now Liverpool can either ask for more money to a team that is willing to pay it or sell to the only team that bid. Keeping Suarez is not a good thing especially if he wants to leave.
